10. John Drummond³ Marshall (Esme², Patience¹ "V") birth date unknown. John died before April 22, 1800 in Worcester Co., MD.

He married twice. He married Ann "Nancy" Wailes May 2, 1776. John married second Delilah Brittingham, daughter of Solomon and widow of Levi Purnell. Date of marriage to Ann Wailes found in back of John's prayer book. (Maryland Historical Society) Ann was the daughter of John Wailes.

Ann died October 18, 1789 in Worcester Co., MD. Found in back of John Marshall's prayer book: "departed this Life on Wednesday at Eliven o clock in the afternoon it being the eighteenth Day of October Anno Domini 1786 Wrote by John Drummond Marshall hir deare Husband." (copy at Maryland Historical Society)

He married Delilah Brittingham in Worcester Co., MD, May 9, 1793. Delilah was the daughter of Solomon Brittingham and Mary(wife of Solomon Brittingham). Mary Brittingham's will was probated in 1784; she named her daughter Deliliah Purnell and three grandchildren: Mary, Milby and Sarah. (Vernon L. Skinner, Worcester Co., MD Wills JW13, p.3) John Drummond is shown as the second son of Esme and Mary Marshall. He was under age in 1764. The "Maryland Herald & Eastern Shore Intelligencer" of April 22, 1800 shows Elizabeth Marshall and Benjamin Wailes as administrators of John D. Marshall late of Worcester County, Pitts Creek Hundred. On May 8, 1800, Benjamin Wailes & Elizabeth Marshall, administrators for the estate showed the following property: Negroes Levin, Ned, Leah, Attalanta, Henry. (David V. Heise, Worcester Co. MD Orphans Court Proceedings, Vol. 1, 1777-1800, p. 303)

A John Marshall served as a Sergeant in the Somerset Militia, Princess Anne Battalion under Capt. George Waters' Pocomoke Company, 1780. Because he took the Oath of Allegiance in Worcester in 1778 before the Hon. James Selby, (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend Books, Westminster, MD, 1999, p. 188) this John may be the brother of Robert, William, Thomas and George, all of whom took the Oath in 1778 before James Selby. William, Thomas and George all served in Worcester Militia. A Robert Marshall also served in the Princess Anne Battalion.

John Drummond Marshall and Ann "Nancy" Wailes had the following children:

82 i. Esme⁴ Marshall was born March 3, 1779. Date recorded in back of John Marshall's prayer book. (copy at Maryland Historical Society) He married ?Sarah Sinks in Davis Co., IN, February 27, 1825. An Esmet Marshall appears in the 1800 census of Dorcester Co., MD.

Marriage records of Davis Co IN show an Esme P. Marshall married Sarah Sinks, bond dated 1825 (research of James H. Marshall). That he is the same Esme Marshall, son of John Drummond Marshall is unknown. Esme would have been about 46 years old in 1825.

83 ii. Elizabeth Marshall was born in Coventry Parish, Somerset Co., MD July 2, 1780. Date recorded in back of John Marshall's prayer book. (copy at Maryland Historical Society; Helen B. Clary, Coventry Parish Records, 1936)

85 iv. Sarah Marshall was born in Coventry Parish, Somerset Co., MD February 22, 1786. Date recorded in back of John Marshall's prayer book. (copy at Maryland Historical Society; Helen B. Clary, Coventry Parish Records, 1936) Sarah died after 1809. October 11, 1798, Administrator for estate of John D. Marshall was to pay William A. Marshall 1/3 of estate as guardian to Sarah. (David V. Heise, Worcester Co. MD Orphans Court Proceedings Vol. I, 1777-1800, p. 299) On April 8, 1800, orphan Sally Marshall is shown with her guardian, William Allen Marshall. Sureties: Frederick Coner and Milby Purnell. (David V. Heise, Worcester Co. MD Orphans Court Proceedings Vol. I, 1777-1800, p. 295) Sarah, with her sister, Mary Smith, sold in 1809 "Marshalls Conclusion" which they inherited from their father, to William Purnell.
